{"id":6933,"date":"2025-01-09T23:37:32","date_gmt":"2025-01-09T20:37:32","guid":{"rendered":"https:\/\/gnbtqytp2s.onrocket.site\/haberler\/law-no-7534-on-amendments-to-the-village-law-and-certain-laws-has-been-published\/"},"modified":"2025-05-25T21:09:52","modified_gmt":"2025-05-25T18:09:52","slug":"law-no-7534-on-amendments-to-the-village-law-and-certain-laws-has-been-published","status":"publish","type":"haberler","link":"https:\/\/www.mfylegal.av.tr\/en\/news\/law-no-7534-on-amendments-to-the-village-law-and-certain-laws-has-been-published\/","title":{"rendered":"Law No. 7534 on Amendments to the Village Law and Certain Laws Has Been Published"},"content":{"rendered":"\n<p><strong>7534 say\u0131l\u0131 K\u00f6y Kanunu ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun<\/strong>, 12 Aral\u0131k 2024 tarihli <strong>Resmi Gazete<\/strong>\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n\n<p>The regulations made in this context are as follows:<\/p>\n\n<p>1. <strong>K\u00f6y \u0130kametinde Ek S\u00fcre:<\/strong><\/p>\n\n<p>K\u00f6y n\u00fcfusuna kay\u0131tl\u0131 olup evi bulunmayan ihtiya\u00e7 sahiplerine sat\u0131lan ta\u015f\u0131nmazlarda \u00e7e\u015fitli sebeplerle bina yapmayan veya taksitlerini \u00f6demeyen hak sahiplerine, ayr\u0131ca 31 Aral\u0131k 2024\u2019e kadar s\u00fcreleri dolacak olanlara binalar\u0131n\u0131 in\u015fa etmeleri ya da \u00f6demelerini tamamlamalar\u0131 i\u00e7in <strong>31 Aral\u0131k 2028\u2019e kadar ek s\u00fcre tan\u0131nm\u0131\u015ft\u0131r<\/strong>.<\/p>\n\n<p>2. <strong>KDV \u0130stisnas\u0131:<\/strong><\/p>\n\n<p>\u00d6zel b\u00fct\u00e7e kapsam\u0131nda faaliyet g\u00f6steren <strong>Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131na<\/strong> yap\u0131lan arsa ve arazi teslimleri, <strong>katma de\u011fer vergisinden istisna tutulmu\u015ftur<\/strong>.<\/p>\n\n<p>3. <strong>\u0130zinsiz Yap\u0131lar\u0131n Y\u0131k\u0131m\u0131:<\/strong><\/p>\n\n<p>Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndaki alanlar dahil olmak \u00fczere, belediyelere, Hazineye, \u00f6zel idarelere ait arazilerde yap\u0131lan <strong>izinsiz yap\u0131lar<\/strong>, Toplu Konut \u0130daresi Ba\u015fkanl\u0131\u011f\u0131, belediyeler veya il \u00f6zel idarelerince y\u0131k\u0131m karar\u0131 kapsam\u0131na al\u0131nm\u0131\u015ft\u0131r. Buna \u00e7evreleyen tel \u00f6rg\u00fc, \u00e7it ve duvar gibi yap\u0131lar da dahildir. <\/p>\n\n<p>4. <strong>\u0130mar Hakk\u0131 Aktar\u0131m\u0131:<\/strong><\/p>\n\n<p>\u0130mar Kanunu\u2019nda yap\u0131lan de\u011fi\u015fiklikle, kamu hizmet alanlar\u0131n\u0131n mali y\u00fck getirmeden kamu m\u00fclkiyetine ge\u00e7irilmesi ve m\u00fclkiyet k\u0131s\u0131tlamalar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 ama\u00e7lanm\u0131\u015ft\u0131r. Bu \u00e7er\u00e7evede <strong>imar hakk\u0131 aktar\u0131m\u0131<\/strong> yap\u0131l\u0131rken, al\u0131c\u0131 parselin in\u015faat alan\u0131, imar plan\u0131nda belirlenen oranlar\u0131 a\u015fmamak kayd\u0131yla <strong>en fazla %30<\/strong> art\u0131r\u0131labilecektir. <\/p>\n\n<p>5. <strong>Bakanl\u0131k Yetkileri:<\/strong><\/p>\n\n<p>Anayasa Mahkemesinin iptal karar\u0131na istinaden, \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131\u2019n\u0131n yetkileri yeniden tan\u0131mlanm\u0131\u015ft\u0131r.
