Basis: <strong>Article 30 of Law No. 1219<\/strong> and the <strong>Constitutional Court&#8217;s decision dated 24.09.2024, E.2024\/99 &#8211; K.2024\/162<\/strong>, confirming the constitutionality of this provision <strong>in terms of foreigners<\/strong>. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Can a foreign dentist see patients in Turkey?&#8221;<\/p>\n<\/blockquote>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>No<\/strong> &#8211; 1219 art.30 + <strong><a href=\"https:\/\/normkararlarbilgibankasi.anayasa.gov.tr\/Dosyalar\/Kararlar\/KararPDF\/2024-162-nrm.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">AYM 2024\/162<\/a><\/strong> clinical practice is prohibited.<\/p>\n<\/blockquote>\n\n<p><strong>If you want to see the processes in full:<\/strong> <a href=\"https:\/\/mfylegal.av.tr\/en\/articles\/work-permit-application-process-2025-step-by-step-guide\/\" target=\"_blank\" rel=\"noreferrer noopener\">Work Permit Application Process<\/a> &#8211; <a href=\"https:\/\/mfylegal.av.tr\/en\/articles\/work-permit-application-requirements-and-required-documents-2025\/\" target=\"_blank\" rel=\"noreferrer noopener\">Work Permit Requirements<\/a><\/p>\n\n<p><strong>Similar but different profession:<\/strong> <a href=\"https:\/\/mfylegal.av.tr\/en\/articles\/foreign-doctor-work-permit-2025-prior-authorization-equivalence-skys\/\" target=\"_blank\" rel=\"noreferrer noopener\">Foreign Doctor (Medical Doctor) Work Permit<\/a><\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>1) Legal Framework: Why Clinical Enforcement is Prohibited?<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 30 of<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.3.1219.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Law No. 1219<\/a><\/strong>: In order to hold the title of &#8220;dentist&#8221; and practice dentistry in Turkey, one <strong>must be a Turkish citizen<\/strong> and <strong>have a diploma from a faculty of dentistry in Turkey<\/strong>.<\/li>\n\n\n\n<li><strong>Constitutional Court 2024\/162<\/strong>: The <strong>Constitutional<\/strong> Court found these conditions to be compatible with the Constitution <strong>also for foreigners<\/strong>. Therefore, it is not possible for foreign nationals to practice <strong>clinical dentistry<\/strong>, whether <strong>private or public<\/strong>. <\/li>\n\n\n\n<li><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=15909&amp;MevzuatTur=7&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Regulation on Foreign Healthcare Professionals in Private Healthcare Organizations (22.02.2012)<\/strong> and its <strong>amendments (16.07.2013, 16.06.2016, 01.04.2017)<\/strong>:<\/a> The scope of the Regulation is regulated <strong>&#8220;except for dentists&#8221;<\/strong>. Although the 2013 amendment introduced some facilities for foreign <strong>physicians<\/strong>, <strong>dentistry<\/strong> <strong>is excluded<\/strong> from this scope. Even the temporary regulations in 2017 <strong>do not open a general door<\/strong> to the clinical practice of dentistry.  <\/li>\n<\/ul>\n\n<p><strong>Conclusion:<\/strong> <strong>Dental practice<\/strong> involving &#8220;clinical&#8221; (patient intervention) <strong>is closed<\/strong> for foreign nationals.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>2) Misunderstood Point: &#8220;Physician Accommodations&#8221; Do Not Cover Dentists<\/strong><\/h2>\n\n<p>The 2013 amendment and the facilitations applied in practice were aimed at foreign health professionals <strong>other than<\/strong> <strong>doctors<\/strong> and <strong>dentists<\/strong> (equivalence, T\u00d6MER period, etc.).<\/p>\n\n<p>These flexibilities <strong>do not apply<\/strong> to <strong>dentistry<\/strong>. With the Constitutional Court 2024\/162, the <strong>1219 Art.30<\/strong> line has been clarified. <\/p>\n\n<p><strong>To avoid confusion:<\/strong> The &#8220;prior authorization\/balance\/T\u00d6MER\/SKYS&#8221; line on the <a href=\"https:\/\/mfylegal.av.tr\/en\/articles\/foreign-doctor-work-permit-2025-prior-authorization-equivalence-skys\/\" target=\"_blank\" rel=\"noreferrer noopener\">Foreign Doctor Work Permit<\/a> page <strong>does not apply to dentistry<\/strong>.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>3) What Can Be Done &#8211; Safe Non-Clinical Alternatives <\/strong><\/h2>\n\n<p>While clinical practice is prohibited, it is possible to perform tasks that do not <strong>involve patient care<\/strong>, which are not considered to be <strong>the practice of a profession<\/strong>. For these positions, general work authorization processes can be applied. <\/p>\n\n<p><strong>Appropriate exemplary roles:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Education &amp; content:<\/strong> Dental device\/product trainings, scientific content production, literature support<\/li>\n\n\n\n<li><strong>R&amp;D &amp; technical expertise:<\/strong> Product development, quality, regulatory, non-clinical technical consulting<\/li>\n\n\n\n<li><strong>Business development &amp; management:<\/strong> Market research, sales operations, KAM\/PM roles<\/li>\n\n\n\n<li><strong>Academic\/theoretical contribution:<\/strong> Seminars, publications, lecture contents without any procedure on the patient<\/li>\n<\/ul>\n\n<p><strong>Critical warning:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Job description, contract, business card\/website\/social media texts should be designed in a way that does not evoke <strong>&#8220;dentist\/clinical practice&#8221;<\/strong>.<\/li>\n\n\n\n<li>All statements must comply with the principle of <strong>&#8220;no patient examination\/diagnosis\/treatment&#8221;<\/strong>.<\/li>\n\n\n\n<li>Job description and KPIs in the application dossier should <strong>clearly<\/strong> indicate &#8220;non-clinical&#8221;
