Process, Conditions and Right of Appeal"},"content":{"rendered":"\n<p>Deportation is the termination of a foreigner&#8217;s stay in Turkey due to <strong>unlawful presence<\/strong>, <strong>public order concerns<\/strong>, or <strong>other reasons specified in the law<\/strong>, making their departure from the country mandatory through an <strong>administrative procedure<\/strong>. This process is regulated under Articles 52-60 of <g id=\"gid_4\"><g id=\"gid_5\">Law No. 6458 on Foreigners and International Protection (LFIP)<\/g><\/g>.  <\/p>\n\n<p>This decision can <strong>only be made by Governorates (Provincial Migration Administration)<\/strong> and the decision process is completed within <strong>a maximum of 48 hours<\/strong>.<\/p>\n\n<p>The deportation decision is often implemented together with <strong>entry ban to the country<\/strong>, <strong>administrative detention (RRC \/ Deportation Center)<\/strong> and <strong>mandatory departure procedures<\/strong>.<\/p>\n\n<p><strong>The most critical point<\/strong>: The <strong>appeal period against this decision is only 7 days.<\/strong><\/p>\n\n<p>Therefore, <strong>swift and professional legal representation<\/strong> directly affects the outcome of the process.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\" id=\"h-1-hangi-durumlarda-sinir-disi-etme-karari-alinir-yukk-m-54\"><strong>1. In Which Cases is a Deportation Decision Made? (LFIP Art. 54) <\/strong><\/h2>\n\n<p>According to Article 54 of Law No. 6458, <strong>deportation decisions must be made<\/strong> for the following persons:<\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><strong>Situation<\/strong><\/th><th><strong>Legal Article<\/strong><\/th><\/tr><\/thead><tbody><tr><td>Those connected to terrorist\/criminal organizations<\/td><td>Art. 54\/1-b<\/td><\/tr><tr><td>Those who use false or misleading documents<\/td><td>Art. 54\/1-c<\/td><\/tr><tr><td>Those who earn their living through <strong>illegitimate means<\/strong><\/td><td>Art. 54\/1-\u00e7<\/td><\/tr><tr><td>Those who pose a threat to public order, security or health<\/td><td>Art. 54\/1-d<\/td><\/tr><tr><td>Those who exceed their visa or permit period by more than 10 days<\/td><td>Art. 54\/1-e, f, g<\/td><\/tr><tr><td>Those found working without work permits<\/td><td>Art. 54\/1-\u011f<\/td><\/tr><tr><td>Those who violate legal entry\/exit rules<\/td><td>Art. 54\/1-h<\/td><\/tr><tr><td>Those who enter the country despite having an entry ban<\/td><td>Art. 54\/1-\u0131<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p><\/p>\n\n<p><strong>Important Note:<\/strong><\/p>\n\n<p>Falling under Article 54 does <strong>not mean you are automatically deported<\/strong>.<\/p>\n\n<p><strong>The following article (Art. 55) provides exceptions.<\/strong><\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>2. Persons Who Cannot Be Deported (LFIP Art. 55)<\/strong><\/h2>\n\n<p>The following persons <strong>cannot be deported under any circumstances<\/strong>:<\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><strong>Situation<\/strong><\/th><th><strong>Legal Article<\/strong><\/th><\/tr><\/thead><tbody><tr><td>Those at risk of torture\/death penalty in the country they would be deported to<\/td><td>Art. 55\/1-a<\/td><\/tr><tr><td>Those unable to travel due to serious health problems, old age or pregnancy<\/td><td>Art. 55\/1-b<\/td><\/tr><tr><td>Those with life-threatening diseases under treatment who cannot receive treatment in their country<\/td><td>Art. 55\/1-c<\/td><\/tr><tr><td>Human trafficking victims under protection<\/td><td>Art. 55\/1-\u00e7<\/td><\/tr><tr><td>Violence victims (psychological\/physical\/sexual) undergoing treatment<\/td><td>Art. 55\/1-d<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p><\/p>\n\n<p>These persons may be granted <strong>humanitarian residence permits<\/strong> (LFIP Art. 46).<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>3. Invitation to Leave Turkey (Voluntary Departure)<\/strong><\/h2>\n\n<p>Persons subject to deportation decisions may be given <strong>15-30 days<\/strong> and issued a <strong>free Exit Permit<\/strong>.<\/p>\n\n<p>If they leave within the deadline, <strong>an entry ban decision may not be imposed<\/strong>.<\/p>\n\n<p>However, the following are <strong>not given time<\/strong> and administrative detention is applied directly:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Those with flight risk<\/li>\n\n\n\n<li>Those who use false documents<\/li>\n\n\n\n<li>Those who pose a threat to public security<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\"><strong>4. Administrative Detention (Deportation \/ Removal Centers &#8211; RRC)<\/strong><\/h2>\n\n<p><strong>Administrative detention decisions<\/strong> are made for the following persons:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Those with flight\/disappearance risk<\/li>\n\n\n\n<li>Those who violate legal entry-exit rules<\/li>\n\n\n\n<li>Those who use false documents<\/li>\n\n\n\n<li>Those who violate the invitation to leave period<\/li>\n<\/ul>\n\n<p><strong>RRC Duration:<\/strong><\/p>\n\n<p>Up to 6 months.<\/p>\n\n<p>If necessary, <strong>can be extended for another 6 months<\/strong>. (LFIP Art. 57) <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Alternative Obligations (LFIP Art. 57\/a)<\/strong><\/h3>\n\n<p>Instead of or after termination of administrative detention, the following obligations may be imposed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Residence at a specific address<\/li>\n\n\n\n<li>Regular reporting<\/li>\n\n\n\n<li>Family-based return<\/li>\n\n\n\n<li>Return counseling<\/li>\n\n\n\n<li>Voluntary public service<\/li>\n\n\n\n<li><strong>Guarantee<\/strong><\/li>\n\n\n\n<li><strong>Electronic monitoring<\/strong><\/li>\n<\/ul>\n\n<p>Total duration <strong>cannot exceed 24 months<\/strong>. If obligations are not complied with, the person may be placed under <strong>administrative detention<\/strong> again. <\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\" id=\"h-5-sulh-ceza-hakimligi-surecleri-idari-gozetim-ve-elektronik-izleme\"><strong>5. Criminal Court of Peace<\/strong> <strong>Procedures (Administrative Detention and Electronic Monitoring)<\/strong><\/h2>\n\n<p>Decisions regarding foreigners placed under administrative detention, extensions and monthly evaluation results are <strong>served with justifications<\/strong>. If the person is not represented by a lawyer, they are informed about <strong>the outcome, appeal procedures and deadlines<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>5.1. Right of Application and its Effect<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Who applies?<\/strong> The foreigner, their legal representative or lawyer.<\/li>\n\n\n\n<li><strong>Where?<\/strong> <strong>Criminal court of peace.<\/strong><\/li>\n\n\n\n<li><strong>Effect?<\/strong> The application <strong>does not suspend administrative detention<\/strong>.\n<ul class=\"wp-block-list\">\n<li>Appeal against <strong>electronic monitoring<\/strong> decisions also <strong>does not suspend the obligation<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>5.2. Review Period and Nature of Decision<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The court concludes the application <strong>within 5 days<\/strong>.<\/li>\n\n\n\n<li><strong>The decision is final.<\/strong><\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>5.3. Re-application in Changed Circumstances<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Claiming that administrative detention conditions have been eliminated\/changed<\/strong> <strong>re-application<\/strong> to the criminal court of peace is possible.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>5.4. Legal Aid (Lawyer Support)<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>Foreigners who appeal to judicial remedies against administrative detention procedures and <strong>cannot afford lawyer fees<\/strong> are provided with <strong>legal services through the bar association<\/strong> under <strong>Law No. 1136 on Advocacy<\/strong> upon request.<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\" id=\"h-6-sinir-disi-kararina-karsi-idare-mahkemesi-itirazi\"><strong>6. Administrative Court<\/strong> <strong>Appeal Against Deportation Decision<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Deadline:<\/strong> <strong>7 days<\/strong> from service.<\/li>\n\n\n\n<li><strong>Venue:<\/strong> <strong>Administrative court<\/strong> (application is also notified to the authority that made the decision).<\/li>\n\n\n\n<li><strong>Process:<\/strong> The court concludes within <strong>15 days<\/strong>.<\/li>\n\n\n\n<li><strong>Decision:<\/strong> <strong>Final<\/strong>.<\/li>\n\n\n\n<li><strong>Protection:<\/strong> <strong>Except with the foreigner&#8217;s consent<\/strong>, they <strong>cannot be deported<\/strong> during the lawsuit.<\/li>\n<\/ul>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Strategic note: For persons in RRC, <strong>two parallel<\/strong> paths work:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Administrative detention<\/strong> for <strong>criminal court of peace<\/strong><\/li>\n\n\n\n<li><strong>Deportation decision<\/strong> for <strong>administrative court<\/strong> Proper timing is decisive for release and legal basis for stay.<\/li>\n<\/ol>\n<\/blockquote>\n\n<p><strong>Deportation decision<\/strong> for <strong>administrative court<\/strong> Proper timing is decisive for release and legal basis for stay.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\" id=\"h-7-sinir-disi-kararinin-uygulanmasi\"><strong>7. Implementation of Deportation Decision<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Foreigners in RRC are taken to <strong>border gates<\/strong> by <strong>law enforcement<\/strong>.<\/li>\n\n\n\n<li>If referral to RRC is not necessary, the procedure is carried out by law enforcement <strong>in coordination with provincial organizations<\/strong>.<\/li>\n\n\n\n<li>The General Directorate may cooperate with <strong>international organizations and relevant country authorities<\/strong> during the process.<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\" id=\"h-8-seyahat-masraflari-pasaport-ve-emanet-paralar\"><strong>8. Travel Expenses, Passport and Deposited Money<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Passports\/other documents<\/strong> may be held until the procedure is completed. Tickets <strong>may be converted to cash<\/strong>. <\/li>\n\n\n\n<li><strong>Principle:<\/strong> Expenses are covered <strong>by the foreigner<\/strong>.<\/li>\n\n\n\n<li>If the foreigner&#8217;s money is <strong>sufficient<\/strong>, they pay the full amount; <strong>the remainder is refunded<\/strong>.<\/li>\n\n\n\n<li>If they have <strong>no money<\/strong>, expenses are covered <strong>by the Presidency<\/strong>.<\/li>\n\n\n\n<li><strong>If partially available:<\/strong> An amount for basic needs is left to the foreigner; <strong>the excess is recorded as Treasury revenue<\/strong>.<\/li>\n\n\n\n<li><strong>As long as expenses are not repaid<\/strong>, <strong>entry to Turkey may not be permitted<\/strong>. If expenses are paid and there are no other prohibitions, <strong>the restriction may be lifted<\/strong>. <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>8.1. Legal Nature of the Debt<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>Expenses are <strong>public debt<\/strong> under <strong>Law No. 6183 Art. 1<\/strong> and are collected <strong>by treasury offices<\/strong>.<\/li>\n\n\n\n<li>According to <strong>Law No. 6183 Art. 104<\/strong>, if the debtor foreigner is <strong>abroad<\/strong>, <strong>statute of limitations does not apply<\/strong> to this debt. Therefore, it is assessed that there is no obstacle to imposing <strong>indefinite restrictions<\/strong>. <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>8.2. Guarantors and Employer Liability<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Natural\/legal persons who guarantee stay\/return<\/strong> are <strong>obligated to pay deportation expenses<\/strong>.<\/li>\n\n\n\n<li><strong>Employers\/representatives who employ foreigners without work permits<\/strong>:\n<ul class=\"wp-block-list\">\n<li><strong>Administrative fine for each foreigner<\/strong> (Law No. 6735 on International Workforce Art. 23\/5, Art. 9).<\/li>\n\n\n\n<li>Obligation to cover <strong>accommodation, return and if necessary health<\/strong> expenses of the foreigner and spouse\/children.<\/li>\n\n\n\n<li>If these expenses are covered from the public budget, they are <strong>collected from the employer<\/strong> under <strong>Law No. 6183<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-9-ornek-vaka-gercekci-senaryo\"><strong>9. Case Example (Realistic Scenario)<\/strong><\/h2>\n\n<p>A foreigner has been subject to a deportation decision under Art. 54\/1-\u011f for working without a work permit. However, the person: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Is in life-threatening danger in their country<\/li>\n\n\n\n<li>Has a chronic disease under treatment in Turkey<\/li>\n\n\n\n<li>Has a Turkish citizen spouse<\/li>\n<\/ul>\n\n<p>In this case, <strong>the Art. 55 exception applies<\/strong> and <strong>the deportation decision may be cancelled<\/strong>.<\/p>\n\n<p>Family unity and right to treatment are <strong>under constitutional and international protection.<\/strong><\/p>\n\n<p>Legal representation directly determines the outcome in such cases.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-10-ornek-vaka-senaryo\"><strong>10.
